Terms of Service

Welcome to OpenQR! These Terms of Service ("Terms") govern your use of the OpenQR mobile applications (iOS and Android), website, and all related services, including video hosting, QR code generation, analytics, and community features (collectively, the "Service"), provided by OpenQR.

OpenQR is a video-first QR code platform that enables Creators to upload videos, generate QR codes, and share content with full privacy control. Viewers can scan QR codes and watch videos, while the Explore tab allows community discovery of public content.

By creating an account, uploading content, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. User Accounts & Eligibility

  • Minimum Age: You must be at least 13 years old to create an account and use the Service. Creators under 18 should have parental or guardian consent.
  • Account Accuracy: You agree to provide accurate, current, and complete information during registration. You are solely responsible for maintaining the confidentiality of your password and account credentials.
  • Account Responsibility: You are responsible for all activities that occur under your account, including content you upload and community actions you take. If you believe someone else is using your account, notify us immediately at support@openqr.io.
  • Creator vs. Viewer: A Creator account allows you to upload videos and create QR codes. A Viewer can watch videos and interact with content but cannot upload videos (unless they upgrade to Creator tier).

2. Creator Content & Intellectual Property

Our Service allows Creators to upload videos, create QR codes, set content visibility, and engage with a community ("Creator Content").

  • Ownership: You retain all ownership and intellectual property rights to your Creator Content. By uploading content to OpenQR, you do not transfer ownership to us.
  • License Grant: By uploading Creator Content, you grant OpenQR a non-exclusive, worldwide license to host, stream, process, and display your content to enable the Service. This license is limited to the duration you maintain your account and your content visibility settings.
  • Your Representations: You represent and warrant that:
    • You own or have the right to grant the necessary rights to your Creator Content
    • Your content does not infringe third-party copyrights, trademarks, or other intellectual property rights
    • Your content complies with all applicable laws and these Terms
    • You have all necessary permissions to use any music, images, logos, or other protected content in your videos
  • Prohibited Content: You may not upload, create, or link to any content that is:
    • Illegal, fraudulent, deceptive, or malicious
    • Defamatory, obscene, offensive, hateful, or harassing
    • Infringing on intellectual property, copyrights, or trademarks
    • Spam, malware, or contains exploitative material
    • Violates the privacy or safety of others
    • Impersonates another person or entity
  • Content Removal: OpenQR uses automated AI moderation and human review to enforce these Terms. We reserve the right to remove, disable, or restrict any Creator Content that:
    • Violates these Terms or applicable law
    • Is flagged by our AI moderation system
    • Is reported by other users for policy violations
    • Is otherwise harmful to the Service or community

3. Content Visibility & Privacy Controls

Creators have full control over content visibility with three options:

  • Private: Only you can view and manage your content. Default setting for all uploads. Private content is never displayed in Explore or shared with other users.
  • Shareable Link: You can share a specific link with chosen people. Content is not indexed in Explore but is accessible via direct link.
  • Public: Content is discoverable in the Explore tab by all users. Your Creator profile (name, profile picture, public bio) is visible alongside public content. You retain full ownership and can change visibility settings at any time.

Changing visibility settings takes effect immediately. You can toggle between settings anytime without losing your content.

4. Community Features & User Conduct

OpenQR includes community engagement features (comments, likes, shares) to build community around video content.

  • Community Guidelines: You agree not to:
    • Post harassing, threatening, abusive, or hateful comments
    • Spam other users' content with promotional or irrelevant content
    • Impersonate other users or creators
    • Post links to malware, phishing sites, or unauthorized content
    • Share others' private information without consent (doxxing)
    • Report content falsely to abuse the moderation system
  • Comment Moderation: Comments are subject to automated AI moderation and human review. We may remove comments that violate these Terms or are harmful to the community.
  • Account Warnings & Suspension: Repeated violations of community guidelines may result in comment removal, account warnings, temporary suspension, or permanent termination at our discretion.
  • Reporting: You can report content or user conduct that violates these Terms. All reports are reviewed by our team.

5. AI Moderation & Enforcement

  • Automated Systems: OpenQR uses AI-powered moderation to detect and flag content that violates these Terms. AI moderation is not perfect and may produce false positives or false negatives.
  • Human Review: Flagged content is subject to human review by our moderation team. We strive to make fair decisions but reserve the right to make final judgments about content compliance.
  • Notification: When content is removed or restricted due to policy violations, we will provide a notification with explanation where possible. For severe violations, accounts may be suspended or terminated without prior notice.
  • Appeals: If your content is removed, you can appeal within 30 days. Appeals are reviewed by a member of our team. We will respond to all appeals within 5 business days.
  • No Liability: OpenQR is not liable for moderation errors, false positives, or content removal decisions, whether automated or manual.

6. Acceptable Use Policy

You agree not to misuse the Service. Prohibited activities include, but are not limited to:

  • Attempting to probe, attack, or exploit our systems
  • Circumventing security measures or authentication
  • Using the Service for illegal purposes or to violate laws
  • Sending spam, unsolicited messages, or bulk uploads
  • Reverse-engineering, decompiling, or attempting to derive source code
  • Scraping, crawling, or automated data collection without permission
  • Attempting to gain unauthorized access to user data or accounts
  • Using bots or automated tools to artificially inflate views, likes, or engagement
  • Interfering with the Service or other users' experience

Violations of this policy may result in account suspension or termination without warning.

7. Fees, Payments, and Subscriptions

  • Subscription Tiers: OpenQR offers Starter (Free), Pro Merchant ($4.99/month), and Enterprise (custom) tiers. The features, limits, and retention policies for each tier are described on our Pricing Page.
  • In-App Purchases: Subscriptions are processed through in-app purchases on iOS (Apple App Store) and Android (Google Play Store). Your subscription will automatically renew each billing period unless you cancel.
  • Cancellation: You can cancel your subscription anytime through your respective app store's subscription management. Cancellation takes effect at the end of the current billing period.
  • Refunds: Refund policies are governed by Apple App Store and Google Play Store terms. Request refunds through the respective platform's refund process. OpenQR does not issue refunds directly for in-app purchases.
  • Free Trial: If OpenQR offers free trials, you must cancel before the trial period ends to avoid being charged. Free trial eligibility may be limited to one per account.
  • Price Changes: We reserve the right to change subscription prices. We will notify existing subscribers of material price increases 30 days in advance.

8. Copyright & DMCA

  • Copyright Infringement: OpenQR respects intellectual property rights. If you believe your copyrighted content has been used without permission on OpenQR, you can submit a DMCA takedown notice.
  • DMCA Notice: Send DMCA notices to support@openqr.io with:
    • Description of the copyrighted work
    • Specific URL of the infringing content
    • Your contact information and declaration under penalty of perjury
    • Your signature (digital or physical)
  • Counter-Notice: If your content is removed due to DMCA, you can file a counter-notice if you believe the removal was erroneous.
  • Repeat Infringers: Users with multiple DMCA violations or copyright infringements may have their accounts terminated.

9. OpenQR Intellectual Property

The OpenQR Service, including its technology, design, code, branding, and trademarks, is the exclusive property of OpenQR and its licensors. You may not copy, modify, reverse-engineer, or distribute the Service without our express written permission. The OpenQR name, logo, and all associated marks are trademarks of OpenQR.

10. Service Availability & Data Retention

  • Service Level: The Service is provided on an "as-is" and "as-available" basis. We do not guarantee uninterrupted service or error-free operation. We are not liable for unavailability or downtime.
  • Data Retention - Starter Tier: Videos and associated data for free "Starter" accounts are automatically deleted after 365 days of account inactivity. You will receive email warnings before automatic deletion.
  • Data Retention - Pro Tier: Videos and analytics for Pro Merchant subscribers are retained indefinitely while your subscription is active. Upon account deletion, all content and data are removed within 30 days.
  • Analytics Retention: Starter tier retains 7 days of analytics. Pro tier retains 2 years of analytics. You can export/download your analytics anytime.
  • Backups: OpenQR maintains backups for disaster recovery. In the event of data loss, we will attempt to restore your content, but we do not guarantee recovery. We are not liable for data loss.

11. Account Termination

  • Your Termination: You can delete your account and stop using the Service at any time. Account deletion removes all personal data within 30 days, though backups may persist longer.
  • Our Termination: We reserve the right to suspend or terminate your account, without notice, if you:
    • Violate these Terms or applicable laws
    • Upload prohibited, infringing, or harmful content
    • Engage in harassment, abuse, or community guideline violations
    • Use automated tools or bots to artificially inflate engagement
    • Attempt to exploit, hack, or abuse the Service
    • Fail to pay subscription fees (after notice and opportunity to cure)
  • Effect of Termination: Upon termination, your account and all associated data are deleted. Public content may remain indexed in search engines. You lose access to all Service features and data.

12. Limitation of Liability & Disclaimers

  • No Warranty: THE SERVICE IS PROVIDED "AS IS," WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. OPENQR DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  • Limitation of Liability: TO THE FULLEST EXTENT PERMITTED BY LAW, OPENQR IS NOT LIABLE FOR:
    • Any indirect, incidental, special, consequential, or punitive damages
    • Loss of profits, revenue, data, or goodwill
    • Third-party claims or actions related to your use of the Service
    • Unauthorized access to your account or data breaches
    • Content posted by other users
    • Service interruptions or unavailability
  • Your Assumption of Risk: Your use of the Service is at your own risk. You are responsible for backing up your content.

13. Indemnification

You agree to indemnify, defend, and hold harmless OpenQR, its officers, directors, and employees from any claims, damages, or costs (including legal fees) arising from:

  • Your violation of these Terms
  • Your content or use of the Service
  • Your violation of any third-party rights or laws
  • Disputes with other users

14. Governing Law & Jurisdiction

These Terms are governed by the laws of the United States, without regard to its conflict of law provisions. Any legal disputes shall be resolved in the state or federal courts of the United States. You agree to submit to the jurisdiction of these courts.

15. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Service, legal requirements, or other factors. We will notify you of material changes by:

  • Posting the updated Terms on this page with an updated "Last Updated" date
  • Sending an email notification for material changes (if you have an account)
  • Requiring explicit consent for changes that materially affect your rights

Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

16. Severability & Entire Agreement

  • Severability: If any provision of these Terms is found to be unenforceable, that provision will be severed and the remaining provisions will continue in full effect.
  • Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and OpenQR regarding the Service. Any previous agreements are superseded.
